# Terms of Service

Please read these Terms of Service ("Terms") carefully before using the HitThePan mobile application (the "App") operated by Hasan Balki ("we," "our," or "us"). These Terms are available at https://hitthepanapp.github.io/hitthepanapp/terms.

By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy, available at https://hitthepanapp.github.io/hitthepanapp/privacy. If you do not agree to these Terms, do not use the App.

## 1. Overview

HitThePan is a beauty product tracking application that helps users monitor their cosmetic product usage, set panning goals, track savings, and connect with friends. The App is available on Apple's App Store for iOS devices.

## 2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to create an account and use the App. By using the App, you represent and warrant that you meet this age requirement.

If you are under the age of 18 (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

## 3. Account Registration

### 3.1 Account Creation

To use the App, you must create an account using one of the following methods:
- **Sign in with Apple**
- **Sign in with Google**

You agree to provide accurate information during registration and to keep your account credentials secure.

### 3.2 Account Responsibility

You are responsible for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized use of your account by contacting **hitthepanapp@gmail.com**.

### 3.3 One Account Per User

Each user may maintain only one active account. Creating multiple accounts to circumvent restrictions or abuse the service may result in account termination.

## 4. Subscription and Payments

### 4.1 Free Tier

The App offers a free tier with limited functionality:
- Up to 5 active product tracking slots
- Access to basic features including product tracking, usage logging, and achievements

### 4.2 HitThePan Pro Subscription

Premium features are available through an auto-renewable subscription ("HitThePan Pro"):

Prices may vary by region and are displayed in your local currency in the App. Prices are subject to change; any price changes will apply to the next billing cycle after notice.

### 4.3 Premium Features

HitThePan Pro unlocks:
- Unlimited product tracking
- Full statistics and analytics
- Savings tracking and dream rewards
- Friend leaderboard access
- Pan diary with photos
- Product routines
- Wishlist management

### 4.4 Payment Terms

- Payment is charged to your Apple ID account at confirmation of purchase
- Subscription automatically renews unless canceled at least 24 hours before the end of the current billing period
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
- You can manage and cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions

### 4.5 Free Trials

If a free trial is offered, the unused portion of any free trial period will be forfeited when you purchase a subscription. Free trial eligibility is determined by Apple and may be available only to new subscribers.

### 4.6 Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple's support channels at https://reportaproblem.apple.com. We do not process refunds directly.

### 4.7 Subscription Downgrade

If your subscription expires or is canceled:
- Your data is preserved and remains on our servers
- Access to premium features is restricted
- If you have more than 5 active products, only the 5 most recently added products will be accessible until you resubscribe
- Resubscribing restores full access to all your data immediately

## 5. User Content

### 5.1 Your Content

You retain all ownership rights to the content you create in the App, including product entries, diary notes, photos, and profile information ("User Content"). By using the App, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the App's services to you.

### 5.2 Content Guidelines

You agree not to upload, post, or transmit any content that:
- Is unlawful, harmful, threatening, abusive, harassing, defamatory, or invasive of another's privacy
- Infringes any patent, trademark, trade secret, copyright, or other proprietary rights
- Contains sexually explicit material, hate speech, or promotes violence
- Impersonates any person or entity
- Contains malware, viruses, or any harmful code
- Is spam or unsolicited commercial content

### 5.3 Content Moderation

We reserve the right to review and remove User Content that violates these Terms or our community standards. We may also suspend or terminate accounts that repeatedly violate these guidelines.

### 5.4 Photo Usage

Photos uploaded to the App (product images, diary photos, avatar) are stored for your personal use within the App. We do not use your photos for advertising, marketing, or any purpose other than providing the App's functionality to you.

## 6. Social Features and Community Standards

### 6.1 Friend Connections

The App includes social features that allow you to connect with other users, view leaderboards, and share progress. By using social features, you agree to interact respectfully with other users.

### 6.2 Public Profiles

You may choose to make your profile public, which allows other users to view your display name, username, avatar, and aggregated statistics. You can disable your public profile at any time.

### 6.3 Reporting and Blocking

You can report users for spam, harassment, inappropriate content, or other violations. You can block users to prevent them from viewing your profile or contacting you. We review reports and take appropriate action, which may include warnings, content removal, or account termination.

### 6.4 Prohibited Conduct

When using social features, you must not:
- Harass, bully, or intimidate other users
- Send spam or unsolicited messages
- Create fake profiles or impersonate others
- Manipulate leaderboard rankings through artificial means
- Collect or harvest other users' personal information
- Use the social features for any commercial purpose

## 7. Intellectual Property

### 7.1 Our Intellectual Property

The App, including its design, code, graphics, logos, icons, and content (excluding User Content), is owned by Hasan Balki and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

### 7.2 Trademarks

"HitThePan" and associated logos are trademarks of Hasan Balki. All other trademarks, service marks, and trade names referenced in the App are the property of their respective owners.

### 7.3 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us a non-exclusive, royalty-free, perpetual, irrevocable license to use, modify, and incorporate such feedback without any obligation to you.

## 8. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, available at https://hitthepanapp.github.io/hitthepanapp/privacy. By using the App, you consent to the practices described in the Privacy Policy.

## 9. Data Accuracy and Financial Disclaimer

### 9.1 Savings Calculations

The App provides estimated savings calculations based on the information you enter. These calculations are for informational and motivational purposes only. We do not guarantee the accuracy of any financial calculations. The savings figures displayed in the App:
- Are based solely on user-entered data
- Do not constitute financial advice
- Should not be relied upon for financial decision-making
- May not reflect actual monetary savings

### 9.2 Product Information

Product information obtained through barcode scanning is sourced from Open Beauty Facts, a community-maintained database. We do not guarantee the accuracy, completeness, or timeliness of this information. Always verify product details independently.

## 10. Disclaimers

### 10.1 "As Is" Provision

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

### 10.2 No Guarantee of Availability

We do not guarantee that the App will be available at all times. The App may be subject to interruptions, including for maintenance, updates, or due to circumstances beyond our control. We may modify, suspend, or discontinue the App or any feature at any time without prior notice.

### 10.3 Third-Party Services

The App relies on third-party services (including Supabase, Firebase, RevenueCat, and Apple services). We are not responsible for the availability, accuracy, or reliability of these third-party services. Your use of these services is subject to their respective terms and privacy policies.

## 11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

- IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

- OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.

- SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

## 12. Indemnification

You agree to indemnify, defend, and hold harmless Hasan Balki from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your use of the App
- Your violation of these Terms
- Your violation of any third party's rights
- Any User Content you submit or share through the App

## 13. Account Termination

### 13.1 Termination by You

You may delete your account at any time through **Profile > Delete Account** in the App. Upon deletion:
- All your data is permanently erased from our servers
- All local data is removed from your device
- This action is irreversible

**Important:** Deleting your account does **not** automatically cancel your subscription. You must cancel your subscription separately through **Settings > Apple ID > Subscriptions** on your device before or after deleting your account. If you do not cancel, Apple will continue to charge you.

### 13.2 Termination by Us

We may suspend or terminate your account if you:
- Violate these Terms or community guidelines
- Engage in fraudulent or illegal activity
- Abuse the App or its features
- Receive multiple verified user reports

We will make reasonable efforts to notify you before termination, except in cases of severe violations where immediate action is necessary.

### 13.3 Effect of Termination

Upon termination:
- Your right to use the App ceases immediately
- We may delete your account data in accordance with our Privacy Policy
- Provisions of these Terms that by their nature should survive termination will continue to apply (including Sections 7, 10, 11, 12, and 15)

## 14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last Updated" date at the top of these Terms
- Notify you through the App or other appropriate means

Your continued use of the App after any changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App and delete your account.

## 15. Governing Law and Dispute Resolution

### 15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

### 15.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be submitted to the competent courts of Istanbul, Turkey.

### 15.3 EU Consumer Rights

If you are a consumer in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

## 16. General Provisions

### 16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.

### 16.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

### 16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

### 16.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

### 16.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, wars, pandemics, internet outages, or third-party service failures.

## 17. Open-Source Acknowledgments

The App uses open-source software components. Licenses for these components are available within the App's source code and are subject to their respective license terms. Key open-source dependencies include SnapKit (MIT License) and Supabase Swift SDK (Apache 2.0 License).

## 19. Apple-Specific Terms

These Terms are between you and Hasan Balki, not Apple Inc. ("Apple"). Apple is not a party to these Terms.

### 19.1 Maintenance and Support

Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. To the extent that any maintenance or support is required, Hasan Balki (not Apple) is solely responsible.

### 19.2 Warranty

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Hasan Balki's sole responsibility.

### 19.3 Product Claims

Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

### 19.4 Intellectual Property Claims

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim. Hasan Balki (not Apple) is solely responsible.

### 19.5 Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

### 19.6 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
